F.D.A. alters detention rule slightly;
to issue record-keeping rule 'shortly'
WASHINGTON - A new Food and
Drug Administration rule allowing the
agency to detain potentially hazardous
food remains all but identical to the
agency's initial regulatory proposal,
with a couple of exceptions.
The Public Health Security and Bioterrorism Preparedness Act
of 2002 gave the F.D.A.
the authority to detain
food it suspects may have
been contaminated by
bioterrorists or disease
threats. The F.D.A. issued details of its
proposed regulation covering the federal
mandate late last year.
The final interim rule on the matter,
published in the June 4 edition of the
Federal Register, maintained virtually all
key elements of the initial proposal (see
Milling & Baking News of June 1, Page 1).
The new regulation gives the F.D.A.
the authority to temporarily seize for up
to 30 days any food its agents suspect of
contamination. At the end of that period,
the agency must either permanently remove the food product from commercial
channels or release it back to the manufacturer or producer.
However, the final rule now states that
if the F.D.A. grants a manufacturer's appeal to so-called temporary "administrative detention" by the agency, a hearing
on the matter must occur within two calendar days of the filing of the appeal for
both perishable and non-perishable food.
The initial rule previously stated that
a hearing for non-perishable food must
occur within three days of the formal
appeal date.
Manufacturers hoping for a hearing
must file an appeal within two days of
receiving a detention order for perishable food and within 10 days for non-

perishable food.
In addition, the interim final rule now
specifies that any detention order must
include the name of the particular F.D.A.
official that approved it.
Otherwise, Sebastian Cianci, a policy
analyst and spokesman with the F.D.A.'s
Center for Food Safety
and Applied Nutrition,
said the final interim
rule
remains
virtually unchanged from the
agency's initial proposal.
"The meat of the rule was the same," Mr.
Cianci said.
The F.D.A. previously issued interim
final rules on two other regulations
stemming from the Bioterror Act, one
covering registration of U.S. food production facilities and the other requiring prior notice to federal officials of
imported food shipments.
The F.D.A. in April reopened the
comment periods on those two rules.
The comment period for facility registration since has closed, but Mr. Cianci
said the agency will receive additional
comments on the prior notice rule
through July 13.
Food processors and manufacturers
still await an interim final rule on the
fourth, last and arguably most controversial regulation stemming from the
Bioterror Act, one covering record-keeping. Mr. Cianci said the agency plans to
issue that final rule "shortly."
The F.D.A.'s initial record-keeping
proposal would require manufacturers
to maintain records of a food product's
or ingredient's immediate previous suppliers, immediate previous transportation carriers, immediate subsequent
recipients and immediate subsequent

Food risk, security conference to examine
new F.D.A. bioterror rules, safety strategies
KANSAS CITY - Dr. David Acheson,
director of the food safety and security
staff with the Food and Drug Administration's Center for Food Safety and Applied Nutrition, will highlight a group of
about two dozen speakers at the Food
Risk and Security Management Conference, June 28-30 at the Hyatt Regency
Crown Center in Kansas City.
The event, co-sponsored by various consulting firms and food safety
interests, will examine implications of
the F.D.A.'s implementation of the 2002
Public Health Security and Bioterrorism

Preparedness and Response Act.
The event also will detail ways to
implement food traceability programs,
maintain food security, enact security
strategies and work with retailers from
a food safety perspective.
In addition to Mr. Acheson, the event
will feature, among others: Chet England,
senior director of quality assurance and
chief food safety officer with the Burger
King Corp.; Harry Kopp, director of corporate safety and security with Corn Products International; and Michael Kennedy,
principal scientist with Cargill, Inc. MBN
