additional or different documentation because of his or her
citizenship or national origin status, even if the employer is
completely ignorant to the prohibition or genuinely believes
that it will assist in the employment verification process, the
request still constitutes intentional discrimination for which an
employer can be held liable. The standard is essentially strict
liability for the action, so ILMA members should be cognizant
to tread very carefully.
Further, the proposed rule clarifies that the prohibitions
are applicable from "cradle-to-grave" of the hiring process,
beginning with an initial referral or discussion, and not simply
the final employment determination stage.
DOJ also seeks to revise the definition and procedure for
charge forms to allow those forms to be completed in any
language and to treat those forms as filed even if incomplete
so long as there is "sufficient information to determine the
agency's jurisdiction."
Additionally, the proposed rule clarifies that charges must be
filed within 180 days of the alleged violation. However, it allows
for a 45-day grace period to allow the DOJ to gather additional
information from the party that submitted the allegation.
If the proposed rule is finalized, it will be important for
ILMA members to review their hiring procedures to ensure
compliance. As outlined above, the biggest change that DOJ
is clarifying is that discrimination does not necessarily involve
intentional hostility or a purposeful act towards a prospective
employee. Rather, an employer could be liable for simply
acting outside the permissible scope of the proposed rule (e.g.,
requesting documents in addition to what is required).
