How Trump May
Roll Back Obama's
Midnight Rules

"Midnight rules" refer to late-term regulations that a presidential administration
attempts to complete before it leaves office.
It is not uncommon for an outgoing administration to issue a flurry of significant
regulations in its final months in office.
For example, Bill Clinton promulgated
361 "economically significant" regulations
(those with over $100 million in annual
cost) during his two terms, with 41 of
those rules issued in the last four months
of his presidency. George W. Bush issued
358 economically significant regulations,
with 48 coming in his last four months in

office. President Barack Obama's administration has published 557 economically
significant regulations through Nov. 15,
2016. As this article goes to print, the
Obama administration has 91 final rules
undergoing review at the Office of Management and Budget's Office of Information and Regulatory Affairs (OIRA).
Previously, in response to that "phenomenon," Congress passed the "Congressional Review Act" (CRA), which
allows lawmakers to nullify regulations if
acted upon within 60 "legislative" days.
The CRA was passed in 1996 as part of
then-House Speaker Newt Gingrich's (RGa.) "Contract with America." Republican lawmakers have tried to stop some
Obama administration regulations using
the CRA; however, the congressional
resolutions of disapproval are vetoed by
the president, and the GOP did not have
the two-thirds majority in the Senate to
override Obama's veto.
The use of this legislative tool could
change with Republicans controlling both
houses of Congress and the White House.
The Congressional Research Service determined in October that the CRA would
apply to any Obama-era regulation published after May 30, 2016. However, the
CRA requires individual consideration of
each regulation Congress wishes to undo,
potentially a cumbersome and time-consuming proposition if the upper and lower
chambers wish to "disapprove" of a large
number of midnight rules.
In response to this issue, Rep. Darrell
Issa (R-Calif.) introduced and the House
of Representatives subsequently passed
H.R. 5982, the "Midnight Rules Relief
Act of 2016" (MRRA). In its most relevant
part, the bill states "a joint resolution of
disapproval may contain one or more such
rules ..." Therefore, Congress may elect
to "package" multiple Obama regulations
into a single resolution and potentially
override multiple rules with one vote.
From a procedural vantage point, the CRA
provides for limited floor debate and, most
importantly, senators may not filibuster.
