The knowledge and comfort level of
the consumer when selecting an ATF is
not the same as it is with an engine oil,
and the changes will create protections
for end users. "It was mostly to make
sure the consumers and service providers
know and understand the performance
properties of the fluid they're going to
use," Ferrick said. "If you're doing transmission service on a vehicle, the service
provider wants a clear understanding of
what the fluid is suitable for."
Ferrick said many lubricant
manufacturers have already changed
their labels. "Transmission fluids have
changed so much that they almost had
to modify their labels to identify what
the fluid is used for," he said.

| Adoption Timeline
Amendments to NIST Handbook 130
will take effect Jan. 1, and roughly half
of the states will automatically adopt
changes to the handbook, making
them effective immediately. "Those
states account for three-fourths of
the population, so it is a significant
amount," Leiter said.
Other states adopt by edition, so
they might need to take legislative action to adopt the edition that is coming
out, Ferrick said. That could give some
marketers more time to comply.
Leiter said California hasn't proposed its timeline for implementing
regulations. However, ILMA has encouraged the California Department
of Food & Agriculture to develop
implementing regulations that do not

restrict the transmission fluid market
in the state.
Questions remain about how states
will address products that were manufactured prior to the regulations taking
effect. Leiter said there is no sell-through
provision as part of the regulation.
Kipp suggested that marketers
work with regulators in their area to
clarify their expectations on labeling
of the product that was produced
prior to Jan. 1, 2018. "If you can
prove the production was prior to
Jan.1, you may have an argument for
the official. This could be a significant
issue for a lot of our customers and a
lot of ILMA members," she said.
