timely manner and acknowledged that some notifiers would
need to submit their late notification as soon as they are able
following the deadline. However, the EPA went on to liken
this process to Chemical Data Reporting (CDR) Form U
submittal and referenced the need for self-disclosure and the
potential availability of penalty mitigation under the EPA's
Audit Policy, if available. This analogy to the CDR program,
and the reference to self-disclosure, indicates the EPA's
enforcement attitude concerning late notification. Its mention
of the Audit Policy forecasts the potential for penalties.
The process of self-disclosure to the EPA and corrective
action itself can also be complicated and risky. Depending
on the situation, the importer might not be eligible to apply
the Audit Policy. Even when all other qualifying elements are
satisfied, late notifiers invoking the Audit Policy to mitigate
penalties must self-disclose within 21 days of first becoming
aware of a possible violation. Documentation might be
requested by the EPA to verify that the discovery occurred
later than the Feb. 7, 2018, submittal deadline. In addition,
corrective action must occur within a somewhat elastic time
frame, but ultimately it must occur. The outcome is uncertain
in cases where the foreign information source refuses to cooperate. The scenarios where the data supplied by the foreign
information source reveals that the chemical substance is not
TSCA Inventory-listed are riskier and more predictable.
Self-disclosure in situations where the Audit Policy is
unavailable, or predictably vulnerable, presents a more
significant level of difficulty. A host of factors must be considered, many of which are inappropriate for discussion here.
Given the relevance of noncompliance with this rule to prior
and subsequent import practices, importers must carefully
examine potential repercussions associated with the options
available. Beyond penalties associated with a missed notification deadline are potential penalties associated with previously
misrepresented TSCA compliance of imported substances
and potential loss of import privileges. Careful consideration
of any prospective action or inaction should be made.
