Hot Topics at #ILMA2018:
THFs and Global Trade
ILMA SESSION HIGHLIGHTS TRACTOR HYDRAULIC FLUIDS
Early in 2018, state regulators in Georgia and Missouri turned their attention to
tractor hydraulic fluids (THF) when they issued a "stop sale" order. The order
targeted THFs labeled as meeting the John Deere "303" specification. Regulators
in Georgia said that the THF 303 specification was discontinued in 1974,
and they required that all THF 303-labeled products be removed from sale
by Aug. 11, 2018.
There is no question that other states will follow Georgia and Missouri. Momentum
is already growing within the National Conference on Weights and Measures
(NCWM) to develop a regulation addressing THFs.
Most recently, the product has become embroiled in litigation. A class-action
lawsuit was filed in July against Tractor Supply Co. and Smitty's Supply Inc. The
plaintiffs claim that yellow buckets of Smitty's Super S Supertrac 303 THF bought
at Tractor Supply stores in Missouri did not meet advertised specs and performance
claims and caused harm and damage to their equipment. This lawsuit could become
problematic for any company manufacturing an "economy grade" THF.
ILMA will host an educational session at its upcoming Annual Meeting on Monday, Oct. 8, 2-3 p.m. to explore THF and the issues surrounding it. What trends
lie ahead for this category? What are the ramifications of the class-action lawsuit,
and how will that affect our industry? What standard or specification should these
products meet? Is there a case to be made for allowing the sale of an "economy
grade" product? The Annual Meeting session will explore all of these questions
with expert panelists.

While you're networking with fellow ILMA members at the Annual Meeting, you
might want to set aside time to visit with representatives of the U.S. Commerce
Department and Export-Import Bank. These representatives will be delivering an
educational session (see page 4) but have also set aside time for individual meetings
with ILMA members who want to learn more about the resources available for small
businesses looking to expand their global reach. Details on setting appointments are

ILMA thanks the Global Affairs & Trade Committee for helping develop this
outstanding session, which will be offered twice, on Monday, Oct. 8, 2-3 p.m.,
and Tuesday, Oct. 9, 10:30-11:30 a.m., so that members have the opportunity to
