household lamps. In a dismal economic climate, however, the decision in Maine is certain to create momentum for other states to adopt the same model. Meanwhile, Montana passed a bill governing thermostat recycling that NEMA supported as complementary to the efforts of the industry-funded Thermostat Recycling Corporation (TRC). Other states considered a more complex and burdensome approach that would require manufacturers, who already provide the nationwide TRC program virtually cost-free, to pay financial incentives to contractors as a way to generate higher recycling rates. Maine and Vermont already have adopted a financial incentive requirement that NEMA contends is overly complex, costly, and unnecessary. Moreover, the results in Maine, where the program has been operational for two years, have been disappointing. NEMA has lobbied successfully against similar programs in other states in 2009 and promotes instead an alternative legislative model that would establish a shared responsibility framework, which experience indicates is more effective at growing the TRC program.
